These Terms and Conditions ("Terms") govern your access to and use of the website www.bazama.com ("Platform"), owned and operated by Bazama Private Limited ("Bazama", "we", "our", or "us"). By using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform. These Terms apply to all visitors, users, buyers, and sellers who access the Platform.
1. GENERAL INFORMATION
- Bazama is an online marketplace that facilitates the listing and sale of handcrafted jewellery and artisanal products by independent sellers ("Sellers") to consumers ("Buyers").
- Bazama acts solely as a facilitator and intermediary under Section 79 of the Information Technology Act, 2000 and assumes no liability for products or services listed on the Platform.
2. ELIGIBILITY
- Users must be at least 18 years old and capable of entering into legally binding contracts under applicable law.
- By registering and using the Platform, you represent that you meet these eligibility criteria.
3. ACCOUNT REGISTRATION AND SECURITY
- Users must register by providing accurate, complete, and current information.
- You are responsible for maintaining the confidentiality of your account and password.
- You agree to notify Bazama immediately of any unauthorized use of your account.
4. USER RESPONSIBILITIES
- Users shall not use the Platform for any unlawful, fraudulent, or harmful activity.
- You agree not to upload, list, or distribute counterfeit, stolen, infringing, or illegal goods.
- You shall not attempt to compromise or damage the Platform’s functionality or interfere with other users' access.
5. SELLER TERMS
- Sellers are solely responsible for the legality, safety, quality, authenticity, and accuracy of their listed products.
- Sellers must complete full KYC verification and comply with all applicable local and international laws.
- Bazama reserves the right to delist products or suspend seller accounts for any violation of these Terms, complaints, or suspicious activity.
6. BUYER TERMS
- Buyers are responsible for reviewing product details and making informed purchase decisions.
- Orders once placed are subject to the cancellation, return, and refund policies stated on the Platform.
7. PAYMENT & TAXATION
- All transactions on Bazama are processed via secure third-party payment gateways.
- Sellers are responsible for declaring and paying applicable taxes including GST.
- Bazama reserves the right to deduct TDS or any applicable charges as per government regulations.
8. INTELLECTUAL PROPERTY
- All content, trademarks, graphics, design elements, and code on the Platform are the intellectual property of Bazama or its licensors.
- Users may not use, copy, reproduce, distribute, or create derivative works from any Platform content without prior written consent.
9. TERMINATION AND SUSPENSION
- Bazama may suspend or terminate your account and access to the Platform for any violation of the Terms or applicable law.
- Users may terminate their account at any time by submitting a written request to customer support.
10. DISCLAIMERS AND LIMITATION OF LIABILITY
- Bazama provides the Platform on an “as is” and “as available” basis and disclaims all warranties.
- Bazama shall not be liable for any indirect, incidental, special, or consequential damages, including product defects, loss of data, or business interruption.
- Bazama is not liable for the conduct of any third-party including Sellers or service providers.
11. INDEMNITY
You agree to indemnify, defend, and hold harmless Bazama, its affiliates, officers, directors, employees, and agents from any losses, liabilities, claims, damages, costs, or expenses (including legal fees) arising out of your use or misuse of the Platform, violation of these Terms, or infringement of third-party rights.
12. DISPUTE RESOLUTION
- In the event of any disputes, both parties shall first attempt to resolve the matter amicably through mediation.
- If unresolved, disputes shall be subject to the exclusive jurisdiction of competent courts in [Insert City], India.
13. FORCE MAJEURE
- Bazama shall not be held liable for any failure or delay in performance due to circumstances beyond its control ("Force Majeure"), including but not limited to natural disasters, acts of God, war, strikes, government actions, cyber-attacks, and power failures.
14. NO AGENCY
- Nothing in these Terms shall be deemed to create any partnership, agency, joint venture, or employment relationship between Bazama and any user or seller.
15. CHANGES TO SERVICES
- Bazama reserves the right to modify, suspend, or discontinue any feature or part of the Platform at any time without liability.
16. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the competent courts located in [Insert City], India.

20. REFUND TIMELINE
All refunds shall be processed in accordance with the Return & Refund Policy and may take 7–10 business days depending on the payment provider.
NOTE: Continued use of this Platform constitutes your acceptance of these Terms and any updates thereto. We reserve the right to amend these Terms at any time. Updates will be posted on the Platform and will become effective upon posting.
